This Privacy Policy describes how Drifka Motors (“we,” “us,” or “our”) collects, uses, stores, and shares information when you visit our website, submit a vehicle, service, or contact inquiry, apply to work with us, or sign in to our employee portal.

1. Who we are

Drifka Motors is a used vehicle dealership located at 202 Rhode Island St, Unit 7, Buffalo, NY 14213.

2. Information we collect

We collect information you provide and limited technical information needed to run the site.

Inquiries and contact forms. When you request information about a vehicle, service, or general question, we collect your name, phone number, and optionally your email address, message, and the vehicle you are asking about.

Careers and ambassador applications. If you apply by email, we receive whatever you send us (typically name, contact details, school, and related background). If we create an employee portal account for you, we store your name, email, phone (if provided), school information, and a hashed password. We do not store your password in plain text.

Portal activity. Ambassadors who use the employee portal may submit referral information (prospect name, contact details, vehicle interest, and notes). That information is used to follow up on referrals and track commissions.

Account security. If you enable two-factor authentication, we store an encrypted authenticator secret and hashed backup codes. We also keep limited login-attempt records to reduce password guessing.

Cookies and local storage. Signed-in sessions use a secure authentication cookie. Your theme preference (light or dark) is stored in your browser. We do not currently use Google Analytics, advertising pixels, or other tracking tools, and we do not sell your data. If we add analytics later, we will update this policy.

Technical data. Our hosting provider may automatically log IP address, browser type, device information, and pages requested for security, uptime, and troubleshooting.

3. How we use information

We use information to:

  • Respond to vehicle, service, and contact inquiries
  • Call, text, or email you about a request you submitted
  • Schedule visits, appraisals, and service work
  • Operate the ambassador / employee portal and pay commissions
  • Protect accounts, prevent abuse, and keep the website secure
  • Improve our inventory, communications, and customer experience
  • Comply with law and respond to lawful requests

We do not sell personal information and we do not share it for cross-context advertising.

4. Calls, texts, and email

If you submit an inquiry with your phone number or email, you agree that we may contact you about that request by phone call, text message, or email. That includes follow-up about a vehicle, appointment, trade-in, or service question. Message and data rates may apply. We do not require this consent as a condition of buying a vehicle.

You can opt out of marketing texts by replying STOP, opt out of marketing emails using the unsubscribe link or by emailing us, and ask us not to call for marketing by telling us during a call or writing to drifkamotors@gmail.com. Transactional messages about a request you already made (for example, confirming an appointment) may still be sent as needed.

5. Who we share information with

We share information only as needed to run the business. That may include service providers who process data on our behalf, such as:

6. Security and breach notification

We take reasonable measures to protect information, including encrypted connections (HTTPS), hashed passwords, session controls, optional two-factor authentication, and access limits on admin and portal accounts.

No website or transmission is completely secure. Please do not send Social Security numbers, full payment card numbers, or other highly sensitive financial data through our public contact forms. For financing or paperwork, we will tell you the appropriate in-person or secure process.

If we become aware of a data breach that affects your personal information, we will notify you and, where required, regulators, as promptly as reasonably possible and as required by New York law (including the SHIELD Act) and other applicable law.

7. How long we keep information

We keep information only as long as we have a business or legal reason to do so:

  • Inquiries and leads: generally up to 3 years after last contact, unless a sale, service job, or dispute requires a longer record
  • Customer / deal records: generally 7 years, or longer if tax, title, or legal requirements say so
  • Portal accounts: while the account is active, then deleted or de-identified within a reasonable time after deactivation unless we must keep payroll or commission records
  • Login-attempt logs: a short period (typically days to a few weeks) for security
  • Hosting / server logs: according to our hosting provider’s default retention

You may ask us to update or delete information we hold about you, subject to records we must retain.

8. Your choices and rights

Depending on where you live, you may have the right to request that we:

  • Confirm whether we have personal information about you and provide a copy
  • Correct inaccurate information
  • Delete information we no longer need to keep
  • Stop selling or sharing your information for advertising (we do not do this)
  • Limit use of sensitive information, where that right applies

New York residents are also protected by applicable state data-security laws, including the SHIELD Act. If California or another state’s privacy law applies to you, we will honor the requests that law requires.

9. Children

This website is intended for adults interested in buying, selling, or servicing vehicles. We do not knowingly collect personal information from children under 13. If you believe a child has submitted information to us, contact us and we will delete it.

10. Changes to this policy

We may update this Privacy Policy from time to time. The “Last updated” date at the top of this page will change when we do. Please review this page periodically. Material changes will be reflected here before they apply to new information we collect.

11. Website use

Vehicle listings, prices, photos, mileage, features, and availability on this website are for informational purposes and may change without notice. A listing is not an offer, guarantee, or contract to sell. A sale is complete only when both parties agree in writing at the dealership (or through another process we confirm) and all required paperwork is signed.

We strive for accuracy but do not warrant that website content is complete, current, or error-free. Inspect any vehicle in person and confirm details before purchase. Financing, trade-in values, and service estimates are estimates until approved in writing.

You agree not to misuse the site, attempt unauthorized access to admin or portal areas, scrape or overload our systems, or submit false or harmful information. We may refuse service, disable accounts, or remove content at our discretion.

To the fullest extent permitted by law, Drifka Motors is not liable for indirect, incidental, or consequential damages arising from use of this website. Our total liability related to website use is limited to the amount you paid us, if any, for the specific transaction at issue, or $100 if no payment was made through the website. Nothing in this section limits rights you have under New York law that cannot be waived.

These terms and this Privacy Policy are governed by the laws of the State of New York, without regard to conflict-of-law rules. Venue for disputes is in the state or federal courts located in Erie County, New York, except where applicable law requires otherwise.
